7.11.12 Refunds
(A) Any transportation development fee
or portion thereof collected pursuant to this chapter which has not been
expended within ten years from the last day of the fiscal year in which
it was paid, shall be refunded to the record owner of the property for
which the development fee
was paid, upon written application by the record owner, with accrued
interest at the rate of return on investments earned by the Town on
such amount.
(B) The Town may
charge a reasonable administrative fee, not to exceed five percent of the
refund due, for verifying and computing the refund.
